These Terms of Service ("Terms") govern your access to and use of the website located at drinkhybrium.com (the "Site"), operated by OrganicMend Nutrition LLC ("Company," "we," "us," or "our"), a Florida limited liability company. Hybrium Balanced Electrolytes is a brand of OrganicMend Nutrition LLC.

By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, your sole remedy is to discontinue use of the Site.

2. Eligibility

The Hybrium® name and logo are trademarks of OrganicMend Nutrition LLC. Nothing in these Terms grants you any right to use our trademarks, trade names, or trade dress without our prior written consent.

You are granted a limited, non-exclusive, non-transferable license to access and view the Site and its content for your personal, non-commercial use only. This license does not include the right to reproduce, distribute, publicly display, or create derivative works from any content on the Site without our express written permission.

7. Returns, Refunds, and Disputes

Amazon Purchases

Returns and refunds for purchases made through Amazon are governed by Amazon's return policy. Eligible returns should be initiated through your Amazon account at amazon.com/returns. Generally, items may be returned within 30 days of delivery if they are unused and in original condition, subject to Amazon's current policies.

Product Issues and Customer Service

If you receive a product that is defective, damaged in shipping, or not as described, please contact us directly at hello@drinkhybrium.com before initiating a return. We want to make it right. For Amazon Vine reviewers or promotional recipients, please contact us directly for any issues.

Chargebacks and Payment Disputes

If you believe a charge is incorrect, please contact Amazon customer service or our team before initiating a credit card chargeback. Chargebacks initiated without first attempting resolution with us or Amazon may result in account suspension from future purchases and may be contested.

8. Disclaimer of Warranties

• YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT THEREON;
• YOUR PURCHASE OR USE OF HYBRIUM BALANCED ELECTROLYTES;
• ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION;
• ANY OTHER MATTER RELATING TO THE SITE OR THESE TERMS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

Some states do not allow the limitation of liability for consequential or incidental damages. If you are located in such a state, the above limitation may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless OrganicMend Nutrition LLC and its members, managers, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms;
• Your use of the Site or any content thereon;
• Your violation of any rights of a third party;
• Your violation of any applicable law or regulation.

11. Dispute Resolution and Arbitration

Informal Resolution First

Before initiating any formal dispute, you agree to contact us at hello@drinkhybrium.com and give us 30 days to resolve the issue informally. Many concerns can be resolved quickly through direct communication.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Site (including disputes about the validity, enforceability, or scope of this arbitration provision) shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as expressly provided below.

Arbitration will be conducted in Miami-Dade County, Florida, or by telephone or video conference at your election if the amount in controversy is under $10,000. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.

Class Action Waiver

YOU AND ORGANICMEND NUTRITION LLC EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. You may only bring claims in your individual capacity.

Exceptions

Either party may bring an individual action in small claims court if the claim qualifies. Either party may also seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Opt-Out

You may opt out of this arbitration agreement within 30 days of first using the Site by sending written notice to hello@drinkhybrium.com with "ARBITRATION OPT-OUT" in the subject line and your name and contact information in the body.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida, and waive any objection to such jurisdiction or venue.

13. Third-Party Links and Services

The Site may contain links to third-party websites, including Amazon.com, social media platforms, and educational resources. These links are provided for convenience only. OrganicMend Nutrition LLC does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party website. Your interactions with third-party sites are governed by those sites' own terms and policies.
